Welcome to Agentcadia (hereinafter referred to as "the Platform", "we", or "us"), an AI Agent marketplace and trading platform. Your privacy is important to us. This Privacy Policy explains how we collect, use, store, share, and protect your personal information when you access or use our platform. By registering for an account or using Agentcadia, you acknowledge that you have read and understood this Privacy Policy and consent to the data practices described herein. This Privacy Policy is incorporated into and forms part of our Terms of Service. If you do not agree with any part of this Privacy Policy, please discontinue use of the platform.
2. Information We Collect
We collect the following categories of information: Account Information: When you register, we collect your username, email address, and password (stored as a cryptographic hash). We do not actively collect sensitive personal information such as your real name, phone number, or physical address. Agent Content: If you create and publish Agents, we collect the configuration files, skill packages, descriptions, and images you upload. Usage Data: We automatically collect information about your interactions with the platform, including browsing history, Agent adoption and creation activity, credit transaction records, search queries, and feature usage patterns. Device and Technical Information: We collect browser type, operating system, language preference, IP address, and general location information (country/region level) derived from your IP address. Payment Information: When you purchase credits, your payment information (such as credit card details) is collected and processed directly by our third-party payment processor. We do not store your full payment card information on our servers. We only retain transaction records (amount, date, status) necessary for our accounting and support purposes. Cookies and Similar Technologies: We use cookies and browser local storage to collect certain information automatically. See Section 7 for details.
3. How We Use Information
We use the information we collect for the following purposes: • Providing Services: To operate and maintain the platform, process your registration, enable Agent adoption and creation, and process credit transactions. • Payment Processing: To facilitate credit purchases and creator payouts through our third-party payment service. • Communication: To send account-related notifications such as transaction confirmations, security alerts, and important platform updates. We do not send unsolicited marketing emails. • Platform Improvement: To analyze usage patterns, diagnose technical issues, and improve user experience and platform features. • Security and Fraud Prevention: To detect, prevent, and address fraud, abuse, security risks, and technical issues. • Analytics: To generate anonymized, aggregated statistics to understand platform usage trends and optimize our services. • Legal Compliance: To comply with applicable laws, regulations, legal processes, or enforceable governmental requests. We will not use your personal information for purposes materially different from those described above without notifying you and, where required by law, obtaining your consent.
4. Information Sharing and Disclosure
We do not sell, rent, or trade your personal information to third parties. We may share your information only in the following limited circumstances: • Payment Processors: We share necessary transaction information with our third-party payment service provider to process credit purchases and creator payouts. The payment processor's handling of your data is governed by their own privacy policy. • Creator Analytics: When creators view their Agent sales data, only anonymized and aggregated statistics are displayed. Individual buyer identities are not revealed to creators. • Legal Requirements: We may disclose your information if required to do so by law, regulation, legal process, or governmental request, or when we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others. • Business Transfers: In the event of a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of that transaction. We will notify you via platform announcement or email before your information becomes subject to a different privacy policy. • With Your Consent: We may share your information for other purposes with your explicit consent.
5. Data Retention
We retain your information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. • Account Information: Retained for as long as your account is active. Upon account deletion, your personal data will be removed within a reasonable timeframe, typically within 30 days and in any event no later than 90 days, subject to our legal retention obligations. • Agent Content: Retained for as long as the Agent is published on the platform. Deleted Agents are removed within 30 days. Agent configurations already adopted by other users will remain accessible to those users. • Transaction Records: Retained for a minimum of 3 years after the transaction date, as required for accounting, tax, and legal compliance purposes. • Usage Data: Retained in identifiable form for up to 12 months, after which it is anonymized or deleted. • Device and Technical Information: Retained for up to 12 months for security and analytics purposes. When data is no longer needed, we securely delete or anonymize it so that it can no longer be associated with you.
6. Data Storage and Security
Your data is stored on secure servers. We employ industry-standard security measures to protect your information, including: • Encrypted password storage (cryptographic hashing); • HTTPS/TLS encryption for all data in transit; • Access controls limiting employee access to personal data on a need-to-know basis; • Regular security reviews and monitoring. However, no method of internet transmission or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. In the event of a data breach that may affect your rights, we will notify affected users and relevant authorities as required by applicable law.
7. Cookies and Local Storage
Agentcadia uses cookies and browser local storage for the following purposes: • Essential Cookies: To maintain your login session and authenticate your identity. These are strictly necessary for the platform to function. • Preference Cookies: To remember your language preference and display settings. • Security Cookies: To support security features and detect malicious activity. We do not use third-party tracking cookies, advertising cookies, or behavioral profiling technologies. Most web browsers allow you to control cookies through their settings. You may choose to disable cookies, but this may affect your ability to use certain features of the platform (such as staying logged in).
8. Your Rights
Depending on your location, you may have the following rights regarding your personal information: • Right of Access: You can access and view your personal information through your profile settings at any time. • Right to Rectification: You can modify your account information, password, and profile details. • Right to Deletion: You can delete Agent content you have created. You may also request deletion of your account and all associated personal data by contacting us at support@agentcadia.ai. Please note that after account deletion, your credit balance cannot be recovered. • Right to Data Portability: You may request a copy of your personal data in a structured, commonly used format. • Right to Restrict Processing: You may request that we limit the processing of your personal data under certain circumstances. • Right to Object: You may object to the processing of your personal data for certain purposes. • Right to Withdraw Consent: Where processing is based on your consent, you may withdraw that consent at any time. For complex requests, we may require additional time, but will respond no later than 90 days. We may ask you to verify your identity before processing your request.
9. Children's Privacy
Agentcadia is not directed at children under the age of 16. We do not knowingly collect personal information from children under 16. If you are under 16, please do not register for an account or submit any personal information to us. If we become aware that we have inadvertently collected personal information from a child under 16, we will take steps to delete such information as soon as possible. 10. International Data Transfers
Agentcadia operates globally, and your information may be stored and processed in countries other than your country of residence. These countries may have data protection laws that differ from those in your jurisdiction. By using the platform, you consent to the transfer of your information to countries outside your country of residence. We will take reasonable steps to ensure that your data is treated securely and in accordance with this Privacy Policy regardless of where it is processed.
